The partition does not need to be empty. Files or folders having the same name as files or folders being cloned will be overwritten. Files or folders having different names will be ignored.
If you're concerned, though, do what I did when I backed up my laptop:
Run Apple Disk Copy. Create a new disk image that's the same size as the amount of files on the volume you are cloning. Put this disk image on the partition you want to clone to.
Tell Carbon Copy Cloner to clone onto the disk image.
Now you have a neat, tidy disk image that contains your entire cloned volume; and no chance of it disturbing anything else on that partition.

No. You cannot boot from a disk image, because a disk image is not a disk. In order to be used, the disk image must first be mounted with a program like Apple Disk Copy--and you can't run any computer programs until you boot your computer.
