At least not for an iPhone, when they once again become widely available soon. Seems they want credit/debit/gift cards only. Thinking.gif

"We require a credit, debit or gift card as payment to discourage unauthorized resellers," said Teresa Brewer, Apple spokesperson.

So what would they have done if Alex Palen had wanted to buy a gift card with that cash? Refuse him, knowing that he was going to turn around and use it on an iPhone?

This is actually an old story - possibly resurrected by Alex Palen's experience. Engadget and others reported on this back in October:

http://www.engadget.com/2007/10/27/apple-r...-per/2#comments

In the stories from October, Apple wasn't accepting gift cards for iPhone purchases either.

Frankly, I think it's a bit silly and certainly not good PR, but Apple are within their rights.

Actually, the "legal tender for all debts" part is what Apple claims gives them the right not to accept cash for the sale. Until one side gives something to the other side, there is, legally, no "debt" created. According to some legal 'schorlars,' any retailer can use whatever method of payment they want in exchange for an item/service, no law requires them to use cash. dntknw.gif

As for the 'age' of the story, I have no info. The story is dated 05/13/08 4:00 am  PT. Article is from the Buffalo News. I assume that is Buffalo, New York. Could be some discontented male cows in California, I suppose! laugh.gif  BTW, apparently, Mr. Palen still wants an iPhone. smile.gif

I think the real problem is the 'legal' aspect of this whole story. Nobody near Steve probably even knows about the 'policy.' And none of the lawyers want to be the one to bring it up! eek2.gif

FAQs: Currency
Legal Tender Status

Question: I thought that United States currency was legal tender for all debts. Some businesses or governmental agencies say that they will only accept checks, money orders or credit cards as payment, and others will only accept currency notes in denominations of $20 or smaller. Isn't this illegal?

Answer: The pertinent portion of law that applies to your question is the Coinage Act of 1965, specifically Section 31 U.S.C. 5103, entitled "Legal tender," which states: "United States coins and currency (including Federal reserve notes and circulating notes of Federal reserve banks and national banks) are legal tender for all debts, public charges, taxes, and dues."

This statute means that all United States money as identified above are a valid and legal offer of payment for debts when tendered to a creditor. There is, however, no Federal statute mandating that a private business, a person or an organization must accept currency or coins as for payment for goods and/or services. Private businesses are free to develop their own policies on whether or not to accept cash unless there is a State law which says otherwise. For example, a bus line may prohibit payment of fares in pennies or dollar bills. In addition, movie theaters, convenience stores and gas stations may refuse to accept large denomination currency (usually notes above $20) as a matter of policy.

The reasoning is not to restrict normal consumers,,,,,,its different,,,,,,I did hear from a friend who is a stock broker, that there is a lot of money laundering going on, and many companies refuse cash.
They want to know where the money is coming from, and who is using it.
And also they want your physical address, no PO boxes any more.
This Patriot Act is cumbersome, but it roots out the people who want to launder American dollars.
It perhaps is an inconvienience for regular people like us, but there is a purpose behind it.
I dont know any details, as I never got interested in this stuff, but I do know that there are a lot of people who need and want to launder their cash from perhaps illegal sources and foreigners who come in and want to load up on goods/securities/antiques/whatever, and go somewhere else, like dissappear.
The IRS needs to update their resources, as there is a lot of this going on. The money leaks out untaxed to other countries for one thing, but this is only the tip of the iceberg.
I heard this in a very quick conversation, but I would assume that there is a lot more to be aware of.
So thats the reason for not accepting cash, and not letting you give a PO box for your address for accounts at a brokerage and so forth.
And there is a LOT of this going on with our American citizens inside USA, big time laundering.

Not to mention the amount of counterfeit money circulating. It has become a way for terrorist  groups to undermine the strength and stability of the dollar/economy. Heaven knows it is not all that strong on its own account.  rolleyes.gif
