Possibly OT: Internet Gambling Arrests,
« on: July 18, 2006, 12:21:16 PM »
I have never done any gambling other than bingo and very occasionally a Powerball ticket to be sociable but I think the DOJ is ready to distract attention from the WWIII and the economy if only for a few minutes:

Off Topic is whatever you guys want to make of it. smile.gif

Use it. Don't use it.

Figure out what is or isn't.

The Admins have never been strict about it here.

It's just a suggestion for use, if appropriate. smile.gif

Well, 3.3 billion dollars in wagers means a potential of $66 million dollars of tax at the 2% rate for illegal bets. I'd say that's a good use of government resources. smile.gif

It could set a dangerous precedent though.

A business man resides in country A. His business is registered in either country A or B. His business is legal in both jurisdictions. However it is or may be illegal in country C. Whilst passing through country C he gets arrested.

This "could" open a can of worms.

Just think of a US (or UK) businessman transiting any number of countries worldwide with a somewhat different understanding of business law and practises. Or indeed a third party country allied to one of those countries.

But if most of the trade is with the residents of the third county and in that county

then he is subject to their laws.

Suppose pornography or cocain were legal in Canada and US citizens were trafficking in it, would that make it OK because it is legal elsewhere?

I hope not.

There are countless examples of US travelers being arrested and held in foreign countries who broke the local laws which might not exist back in the states. The reverse is also true.

Yes, it "could" be a thin line that needs to be walked carefully. I think this is a test case to see just how much can be done to control business practices across borders on this new venue called the internet. smile.gif

But in this case the customers may be in country C (The US) but they are effectively doing business in country A or B.

Several years ago the UK Government decided to ban a book called Spycatcher. Many UK citizens bought this book by mail order (this was pre Amazon  smile.gif ). Does this mean that the UK government can arrest any executive of the US retailers if he or she transits the UK?

If the UK has a law that says they must pay tax on those sales and they don't...then yes.

krissell

In the Spycatcher case tax wasn't the issue. The UK government had banned the sale and import of the book. So in effect US citizens were knowingly involved in the trafficking of an illegal product.  smile.gif

Can't speak to that situation. In the internet gambling case, the owners were arrested not for the illegality of their business but for not paying taxes.

Our government often uses that reason to indict criminals since that is easier to prosecute than other more escapable clauses. Many of the US Mafia were convicted not for their illegal activities (murder, gambling, drugs) but for avoiding federal taxes. rolleyes.gif

Good morning krissel - I never know what subject is going to stir people up.

I think that every government should be able to collect taxes on internet gambling and, within reason, on internet sales since all of the state sales tax is drying up into internet sales.  I believe that if the US government doesn't get cooperation on collecting these taxes then they should be able to ask that the websites be taken down or filtered within this country.

But if the taxes HAVE been paid in the country where the transaction took place?

Not taking any sides in this. I just think that it "could" open up a can of worms. smile.gif
